These terms of service ("Terms") govern your use of the SkyWave mobile application ("the App") provided by Johnston Software & Services LLC ("we," "us," or "our"). By using the App, you agree to these Terms.

Use of the App

The App provides real-time HF radio propagation information and band recommendations for licensed amateur radio operators and enthusiasts. The App is intended for informational and educational purposes.

You agree to use the App only for lawful purposes and in accordance with these Terms.

Accuracy and Disclaimers

The App provides propagation estimates and band recommendations based on data from third-party sources including NOAA Space Weather Prediction Center, KC2G, and HamDB. While we strive for accuracy:

  • Propagation conditions are inherently variable and unpredictable. Recommendations are estimates, not guarantees.

  • Data from third-party sources may be delayed, incomplete, or temporarily unavailable.

  • The App is not a substitute for your own judgment as a radio operator.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Subscriptions and Purchases

Some features of the App require a paid subscription ("Pro"). Subscriptions are processed and managed through the Apple App Store or Google Play Store. All purchases are subject to the terms of the respective app store.

  • Subscription pricing and terms are displayed in the App before purchase.

  • Refunds are handled by the Apple App Store or Google Play Store according to their refund policies.

  • We reserve the right to change subscription pricing. Changes will not affect active subscription periods.

Intellectual Property

The App, including its design, code, content, and branding, is the property of Johnston Software & Services LLC. You may not copy, modify, distribute, or reverse-engineer any part of the App.

Amateur radio data, space weather information, and propagation data sourced from NOAA, KC2G, and HamDB remain the property of their respective owners.

Limitation of Liability

To the maximum extent permitted by law, Johnston Software & Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

  • Inaccurate propagation recommendations

  • Loss of data stored on your device

  • Interruption of service due to third-party data source outages

  • Any action taken based on information provided by the App

Our total liability for any claim arising from use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

Termination

We reserve the right to discontinue the App or any of its features at any time. You may stop using the App at any time by uninstalling it from your device.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law provisions.
